This is what leaning on the XIVth Amendment leads to, instead of emphasizing the fact that birthright citizenship has been part of English Common Law for many centuries.

After the Civil War, we had a unique situation where a whole population were born here, yet according to the Dred Scott decision, were not citizens. They could have all been naturalized, but that would have been an administrative nightmare.

The Amendment overturned Dred Scott, and freed slaves became citizens. That was 150 years ago, and no one for whom the XIVth Amendment changed anything is still alive, but the law remains. It applies to everyone as it always has except for that unique group.

Talking about the XIVth Amendment or Wong Kim Ark is just handing the xenophobes what they want, some unique decision that can be repudiated, so that centuries of Common Law will go away. It won’t.

That may be the case, but common law by-and-large is not enforceable. It’s written laws in this country the courts consider. They don’t give a crap about English common law (we’re not England).

A law can be written based on common law.

The most common example in the USA is the common law marriage. A whole lot of people mean a whole lot of things by that, most of which is in fact not recognised as marriage. What matters is how the state defines it in law.

For example:

A common-law marriage is recognized for federal tax purposes if it is recognized by the state or jurisdiction where the taxpayers currently live, or in the state where the common-law marriage began. If the marriage is recognized under the law and customs of the state or jurisdiction in which the marriage takes place (even in a foreign country), the marriage is valid for tax purposes (Rev. Rul. 58-66). Specific state or jurisdiction requirements for a common-law marriage to be recognised must be considered by couples contemplating filing joint returns.

If the state doesn’t recognise the marriage as valid (which would require a legal definition) the IRS doesn’t either. That might not change how you view your relationship, but it does change how the state (and other states, and the Feds) do.

That’s why cases such as Wong Kim Ark matter. If you can overturn them, you can put in something else which would also be lawful.

Interesting. One of the UK’s major terrestrial TV channels, Channel 4, is moving it’s headquarters from London to Leeds, with two new “creative hubs” in Bristol and Glasgow.

Personally, I think they missed a trick here: if, instead of Bristol (England), they picked Cardiff (Wales), which is just across the river, they would have had a presence in every nation in the mainland UK. Still, it’s very interesting to see how the UK wide channels are regionalising. The BBC already has quite a lot of it’s UK-wide output produced in Manchester, Glasgow, and Cardiff.

A couple of threads ago someone posted a link to the “Everything is Awful Podcast” interview of Jacob Wohl.(everythingisawfulpodcast.podbean.com) I appreciate the poster and my comments about the podcast do not reflect upon them. I feel I got what I needed out of it.

I half listened to about 40 minutes of the hour+ long podcast while going through posts on this thread. That was enough for me.

Here are some of my thoughts:

In the interview, Wohl called himself a “performance artist”. And he showed a degree of polish in that particular skill.

But another term for what Wohl does is what Harry Frankfurter calls “Bullshitting”. Basically this is a person untethered to the concepts of truth and falsehood. Or as the wiki describes it:

“Frankfurt determines that bullshit is speech intended to persuade without regard for truth. The liar cares about the truth and attempts to hide it; the bullshitter doesn’t care if what they say is true or false, but rather only cares whether their listener is persuaded.”

So basically, you cannot believe a word the “performance artist” says without independently verifying it. They happily and readily lie.

And, sadly, the interviewer seems to have been woefully unprepared for this.

It is hard to fault him as a lot of professional journalists are still at a loss on how to handle “performance artists” such as Trump. But I do think that solutions are slowly gelling on the national stage.

The storefront to the left of Coldstone Dairy is the Squirrel Hill Cafe, known locally as “The Squirrel Cage”.

Not meaningless, since insurgencies with rifles can do a LOT of damage…but the idea that you were going to save the Jewish people is utterly farcical.

Also, insurgents do depend on the enemy having a sense of proportionality, which is something the Germans absolutely did not have. We were never going to exterminate half the Vietnamese population to stop the VC, and even the Soviets ran into hard limits on just how much bloodshed they were willing to inflict on the Afghan population.

The Nazis had no limits. None.

Interesting. One of the UK’s major terrestrial TV channels, Channel 4, is moving it’s headquarters from London to Leeds, with two new “creative hubs” in Bristol and Glasgow.

Personally, I think they missed a trick here: if, instead of Bristol (England), they picked Cardiff (Wales), which is just across the river, they would have had a presence in every nation in the mainland UK. Still, it’s very interesting to see how the UK wide channels are regionalising. The BBC already has quite a lot of it’s UK-wide output produced in Manchester, Glasgow, and Cardiff.

Doctor Who is already in Cardiff; aren’t they BBC?

Washington state Rep. Matt Shea acknowledged Wednesday he had distributed a four-page manifesto titled “Biblical Basis for War,” which describes the Christian God as a “warrior,” details the composition and strategies of a “Holy Army” and condemns abortion and same-sex marriage.

The document is organized in 14 sections with multiple tiers of bullet points and a smattering of biblical citations. Under one heading, “Rules of War,” it makes a chilling prescription for enemies who flout “biblical law.” It states, “If they do not yield - kill all males.”

After the document was leaked online Tuesday, the Spokane Valley Republican insisted he was not promoting violence and that the message had been taken out of context.

I’d go so far as to argue that the 9th Amendment was intended to give courts the power to continue the common law tradition, which more than anything was a historical practice by the courts of recognizing/declaring pre-existing natural rights.

So, yes, there’s no federal common law - and most of the States have taken to ratifying common law traditions to varying degrees. But, also, the courts have continued to recognize and protect natural rights.

On that issue of common law, my own marriage would be considered common law (and over half the US states would not recognise it), because my wife and I simply exchanged vows (sort of) in a ghost town in Colorado with no witnesses or officiants. Just us and aspen trees (and a chipmunk).

What makes it recognized across the country (and the world) is the piece of paper that Saguache County, Colorado issued, not our word for it.

US v. Wong Kim Ark says very explicitly that US jus soli citizenship is based on the English common law definition of natural born subject. Since there is no definition of “natural born” citizen in the US Constitution, the concept has to be based in common law.

Yeah, and that’s mostly my point. The bit about there being no federal common law is from a Supreme Court case called Erie RR v Pennsylvania. The Court ruled that in diversity jurisdiction cases (cases between parties from different states) the lower federal courts had to apply state common law and couldn’t create there own. But there were still areas of federal law that relied on common law or at least common law practices.

As the country and the law has modernized in the last 100 years or so, there’s less and less need for common law because we have mostly codified everything. And even the common law was written down, just usually by judges to resolve issues - even common law marriage was originally conceived by a judge and later codified in statue by the jurisdictions who allow it. Where the practice is most important now, as I’ve mentioned are cases involving the Equal Protection Clause.

Long story short, from the E-mail going back-and-forth between the group, the radio host (named Cindy) and my wife, Cindy apparently thought everyone should know who she is, even people who live in Nebraska. Hence her snippy response and me hanging up on her.

Assuming this still happens tomorrow, she’s supposed to call us at 12:30 MT tomorrow to put my wife on the air (2:30 ET).

I early-voted in person this afternoon. The location wasn’t crowded but there was a steady stream of people coming through. I voted straight ticket, but that’s nothing new to me. I’ve voted for at most a dozen republican candidates since I started voting in 1972.

I came home from work today to find that someone had raked all of my boulevard leaves into the street. The city is sweeping the streets tomorrow and a lot of neighbors have raked their leaves into the street. The city’s website says they’ll ticket people who do that, but the neighbors told me that they never do it. I guess I’ll take the chance and hope that my unknown raking neighbor doesn’t cost me a lot of money.

Giving out a box of full size candy bars. If we give all of them out, we have a big-ass bag of quality fun size bars. If the kids come to our house, they will NOT be disappointed.
